DIAL-HOUSE ONLINE STORE TERMS AND CONDITIONS

§ 1. General provisions

These Terms and Conditions set out the rules for using the Dial-House online store, available at: https://dial-house.com.

The Dial-House online store is operated by:

The Seller conducts sales as part of a non-registered business activity pursuant to Article 5(1) of the Act of 6 March 2018 - Entrepreneurs' Law.

If the Seller begins conducting registered business activity, these Terms and Conditions will be promptly updated with the Seller's registration details, including tax identification number, statistical number and other required information.

The store sells watches and may provide services related to searching for, verifying, advising on, sourcing, purchasing or exchanging watches.

The Terms and Conditions are available free of charge on the store's website in a manner that allows them to be obtained, recorded and reproduced.

Before placing an order, the customer should read the Terms and Conditions, Privacy Policy, Return Policy and Shipping Policy.

§ 2. Definitions

Store - the Dial-House online store available at https://dial-house.com.

Seller - Karol Góral, operating the Dial-House online store as part of a non-registered business activity.

Customer - a natural person, legal person or organisational unit making a purchase or using the forms available in the store.

Consumer - a natural person entering into a legal transaction with the Seller that is not directly related to their business or professional activity.

Entrepreneur with consumer rights - a natural person entering into an agreement directly related to their business activity, if the content of that agreement indicates that it is not of a professional nature for that person.

Product - a watch or other item offered by the store.

Current offer - products available in the store at the time of placing an order, ready for purchase through the website.

Individual order - an order concerning a product or service fulfilled on the basis of individual arrangements with the customer, in particular through the "Find a watch" or "Source a watch" forms.

Form - a contact form available on the store's website, used to submit an enquiry regarding a watch, purchase, exchange or other service.

Sales agreement - an agreement concluded between the customer and the Seller, the subject of which is the sale of a product.

Individual service - a service consisting of searching for, verifying, advising on, reserving, sourcing or preparing a watch proposal in response to the customer's individual enquiry.

§ 3. Nature of the offered products

The store offers, in particular, used, vintage, collectible and other watches selected by Dial-House.

Used, vintage or collectible products may have natural signs of use, ageing, servicing or storage. Information about the condition of the product, the scope of the set, possible signs of use, service history or other important features is provided in the product description, if known to the Seller.

Product photographs form part of the offer and are intended to present the actual appearance and condition of the product. Colours and details may slightly differ depending on the customer's screen settings.

In the case of used and vintage watches, the customer acknowledges that the condition of the product is assessed taking into account its age, nature, offer description, photographs and information provided before purchase.

If a given watch is covered by a Dial-House warranty or another warranty, the scope and duration of the warranty are indicated in the product description or in a separate warranty document.

A warranty, if granted, does not exclude or limit the customer's rights arising from the provisions on lack of conformity of goods with the agreement.

§ 4. Current offer and conclusion of a sales agreement through the store

Products included in the current offer of the store may be purchased directly through the website, provided that they are available.

To place an order, the customer should:

a) select a product,

b) add the product to the cart,

c) provide the required data,

d) select a delivery and payment method,

e) accept the required consents and regulations,

f) confirm the order.

Placing an order by the customer means submitting an offer to conclude a sales agreement.

The sales agreement is concluded upon confirmation of acceptance of the order by the Seller, unless otherwise indicated for a given product, payment method or individual arrangements.

The Seller reserves the right to cancel an order if:

a) the product is not available,

b) there is an obvious error in the price or product description,

c) the customer provided incorrect or incomplete data,

d) payment was not made within the specified time limit,

e) there is a justified suspicion of abuse or action contrary to the Terms and Conditions.

If a paid order is cancelled, the Seller will refund the payment received from the customer.

§ 5. "Find a watch" and "Source a watch" forms

The "Find a watch" and "Source a watch" forms are used to submit an individual enquiry regarding the search, matching, verification or sourcing of a watch.

Submitting a form is not equivalent to concluding a sales agreement, placing an order for a product or creating an obligation to purchase.

After receiving the form, Dial-House may contact the customer in order to clarify expectations, in particular regarding the brand, model, reference number, budget, condition of the watch, scope of the set, completion time and other individual preferences.

On the basis of the submission, Dial-House may present the customer with product proposals, possibilities of sourcing a watch or an individual offer.

A sales agreement or an agreement for an individual service is concluded only after the customer accepts the individual offer presented by Dial-House.

An individual offer may include in particular:

a) a description of the watch,

b) brand, model, reference number and other important parameters,

c) technical and visual condition,

d) scope of the set,

e) price,

f) completion time,

g) payment method,

h) amount of an advance payment, deposit or service fee, if applicable,

i) delivery method,

j) rules for withdrawal from the agreement,

k) information about the possible absence of the right of withdrawal from the agreement in cases provided for by law.

§ 6. Individual orders

Orders fulfilled as part of "Find a watch" or "Source a watch" may have the nature of individual orders.

An individual order may in particular concern a watch:

a) sourced specially at the customer's request,

b) not available in the store's standard current offer,

c) found according to the customer's individual criteria,

d) reserved or purchased by the Seller on the basis of the customer's individual acceptance,

e) selected according to parameters indicated by the customer, such as brand, model, reference number, budget, condition, set completeness, year, case size, dial colour or other arrangements.

In the case of an individual order, the Seller will present the customer with an individual offer for acceptance.

Acceptance of an individual offer by the customer may take place in particular by:

a) signing the offer or agreement,

b) accepting the terms by e-mail,

c) making a payment,

d) ticking the required declarations,

e) another clear confirmation indicated by the Seller.

The Seller does not begin fulfilling an individual order, in particular does not purchase, reserve or source the watch, until the customer has accepted the individual offer and fulfilled the agreed payment conditions.

If the subject of the order is a non-prefabricated item, sourced or prepared according to the customer's specifications or intended to satisfy the customer's individual needs, the right of withdrawal from the agreement may not apply in cases provided for by applicable law.

Information about the possible absence of the right of withdrawal from the agreement will be provided to the customer before the final confirmation of the individual order.

By accepting an individual offer, the customer may be asked to confirm that:

a) the watch is being sourced or reserved specially for their individual order,

b) the watch is not included in the store's standard current offer,

c) the parameters of the watch have been accepted by the customer,

d) the customer has been informed about the possible absence of the right of withdrawal from the agreement in cases provided for by law,

e) the customer understands that after the fulfilment of an individual order has begun, withdrawal from the agreement may not be possible if the statutory conditions for excluding the right of withdrawal are met.

The provisions concerning individual orders do not limit the customer's rights arising from the provisions on lack of conformity of goods with the agreement.

§ 7. Individual services

Dial-House may provide individual services, in particular:

a) searching for a watch,

b) verifying offers,

c) checking the authenticity and condition of a watch,

d) purchase advisory services,

e) reserving a watch,

f) arranging the sourcing of a watch,

g) arranging cleaning, servicing, repair or selection of accessories.

An individual service may be free of charge or paid, depending on the arrangements with the customer.

If an individual service is paid, its scope, price, deadline and settlement rules will be presented to the customer before the service begins.

If the customer expressly requests that the performance of a paid individual service begin before the expiry of 14 days from the conclusion of the agreement, the Seller may begin its performance after obtaining the customer's express consent.

If a paid individual service is fully performed with the customer's express consent, and the customer was informed before the service began that after full performance of the service they would lose the right of withdrawal from the agreement in relation to that service and acknowledged this, the customer may not have the right to withdraw from the agreement in relation to that service.

If the customer withdraws from an agreement for a paid individual service after its performance has begun, but before it has been fully performed, the customer may be obliged to pay for the services provided up to the moment of withdrawal, proportionally to the scope of the service performed, in accordance with applicable law.

§ 8. Prices and payments

All prices in the store are given in Polish zloty.

Product prices are final prices for the customer, unless otherwise indicated next to the product or during the order process.

Available payment methods may include in particular:

a) card payment,

b) Shopify Payments,

c) PayPal,

d) traditional bank transfer,

e) other methods made available in the store.

In the case of a traditional bank transfer, the order will be forwarded for fulfilment after the payment has been credited to the Seller's bank account.

In the transfer title, the customer should provide the order number.

Failure to make payment within the specified time limit may result in cancellation of the order.

In the case of individual orders, the Seller may require an advance payment, deposit, reservation fee, individual service fee or payment of the full price before fulfilment begins. These conditions will be indicated in the individual offer.

In the case of individual orders, the nature of the amount paid, in particular whether it is an advance payment, deposit, service fee or payment for a product, should be clearly specified in the individual offer.

§ 9. Delivery and collection

Product delivery is carried out within the territory of Poland, unless the Seller individually agrees otherwise with the customer. For questions regarding international delivery, please contact us at: kontakt@dial-house.com.

Available delivery methods may include in particular:

a) InPost Parcel Locker,

b) another registered shipment,

c) personal collection in Szczecin after prior arrangement.

The delivery cost is indicated during the order process.

Shipment takes place after payment has been credited or after other conditions indicated in the individual offer have been fulfilled.

For valuable products, the Seller may apply additional shipment security measures, insurance, delivery confirmation or other measures intended to ensure safe delivery.

The customer should check the condition of the shipment upon receipt. In the event of visible damage to the packaging, it is recommended to prepare a damage report with the carrier and immediately contact the Seller.

Personal collection is possible only after prior individual arrangement of the date, time and place of collection.

§ 10. Right of withdrawal from the agreement

A consumer and an entrepreneur with consumer rights who concluded a distance sales agreement generally have the right to withdraw from the agreement within 14 days from the date of receiving the product, without giving any reason.

To meet the deadline, it is sufficient to send a statement of withdrawal from the agreement before the expiry of the 14-day period.

The statement of withdrawal may be sent to the e-mail address: kontakt@dial-house.com.

After submitting the statement of withdrawal, the customer should return the product without delay, no later than within 14 days from the date of submitting the statement of withdrawal.

The product should be returned to the following address:

The cost of returning the product is borne by the customer, unless the Seller agrees otherwise with the customer or applicable law provides otherwise.

The Seller will refund the payment received from the customer, including the cost of the least expensive standard delivery method available in the store for the given order, if such cost was borne by the customer.

The Seller may withhold the refund until the product has been received back or until the customer has provided proof of sending it back, whichever occurs first.

The refund will be made using the same payment method that the customer used for the purchase, unless the parties agree on another refund method.

The customer is responsible for any decrease in the value of the product resulting from using it in a manner exceeding what is necessary to establish the nature, features and functioning of the product.

The returned product should be sent back complete, together with all items received at the time of purchase, in particular the box, documents, warranty card, additional links, strap, accessories and other elements of the set, if they were part of the offer.

Watches are valuable and delicate products, therefore the customer should properly secure the product for the return shipment. Registered shipping with a tracking number and appropriate insurance is recommended.

§ 11. Exclusions from the right of withdrawal from the agreement

The right of withdrawal from the agreement does not apply in cases provided for by applicable law.

In particular, the right of withdrawal from the agreement may not apply to an agreement whose subject is a non-prefabricated item manufactured according to the customer's specifications or intended to satisfy their individual needs.

The right of withdrawal from the agreement may also not apply to a paid individual service if the service has been fully performed with the customer's express consent, and the customer was informed before the service began that after full performance of the service they would lose the right of withdrawal from the agreement in relation to that service and acknowledged this.

In the case of individual orders fulfilled as part of "Find a watch" or "Source a watch", information about the possible exclusion of the right of withdrawal will be provided to the customer before the conclusion of the agreement or before final confirmation of the individual offer.

The mere submission of the "Find a watch" or "Source a watch" form does not exclude the right of withdrawal, because the form is only an enquiry. Any limitation or exclusion of the right of withdrawal may apply only to an individual agreement concluded after the customer accepts a specific offer.

The exclusion of the right of withdrawal from the agreement does not limit the customer's rights arising from the provisions on lack of conformity of goods with the agreement.

§ 12. Complaints and lack of conformity of goods with the agreement

The Seller is liable towards the consumer and the entrepreneur with consumer rights for the conformity of goods with the agreement in accordance with applicable law.

A complaint may be submitted to the e-mail address: kontakt@dial-house.com.

The complaint should include:

a) the customer's first name and surname,

b) the order number,

c) a description of the reported non-conformity,

d) the customer's request,

e) photographs of the product or packaging, if they may help in examining the complaint.

The Seller will examine the complaint within 14 days from the date of receiving it.

If the product is not in conformity with the agreement, the customer may request that the product be brought into conformity with the agreement, in particular by repair or replacement, taking into account the nature of the product, its availability and applicable law.

In the case of used, vintage or collectible watches, the assessment of the product's conformity with the agreement takes into account the offer description, photographs, indicated product condition, its age, completeness and information provided to the customer before purchase.

A complaint does not cover product features about which the customer was clearly informed before the conclusion of the agreement and which the customer accepted, in particular natural signs of use, age, patina, scratches, abrasions, discoloration, service marks or other elements described in the offer.

The provisions of these Terms and Conditions do not limit the customer's statutory rights arising from the provisions on lack of conformity of goods with the agreement.

§ 13. Dial-House warranty

Selected products may be covered by the Dial-House warranty.

Information about whether a product is covered by a warranty, the warranty period and its scope is indicated in the product description, purchase confirmation or a separate warranty document.

The Dial-House warranty may cover selected elements of the functioning of the watch, in particular the movement, if indicated in the product description or warranty document.

The warranty does not cover in particular:

a) mechanical damage,

b) damage caused by dropping, flooding, impact or improper use,

c) natural wear of consumable elements,

d) strap, bracelet, glass, crown, case or external elements, unless the warranty document provides otherwise,

e) interference by third parties,

f) defects or features of the product clearly indicated in the offer description.

Detailed warranty terms may be specified individually for a given product.

The warranty does not exclude or limit the customer's rights arising from the provisions on lack of conformity of goods with the agreement.

§ 14. Purchase and exchange of watches

The "Purchase / exchange" form is used to submit an enquiry regarding the possibility of selling a watch to Dial-House or leaving it as part of a settlement when purchasing another watch.

Submitting the "Purchase / exchange" form is not equivalent to concluding a sales agreement, accepting the watch for purchase or creating an obligation to present an offer.

After receiving the submission, Dial-House may contact the customer in order to determine details, verify the watch, documents, technical condition, completeness and origin of the product.

Any valuation is individual in nature and may depend on personal verification of the watch, documents and technical condition.

A purchase or exchange agreement is concluded only after the terms have been individually agreed and accepted by both parties.

§ 15. Personal data and privacy

The controller of customers' personal data is Karol Góral, operating the Dial-House online store as part of a non-registered business activity.

Customers' personal data is processed in particular for the purpose of:

a) handling orders,

b) processing payments,

c) delivering products,

d) handling contact forms,

e) handling complaints, returns and enquiries,

f) fulfilling legal obligations,

g) communicating with the customer,

h) marketing, if the customer has given appropriate consent.

Detailed information regarding the processing of personal data is included in the Privacy Policy available on the store's website.

The customer has the right to access their data, rectify it, erase it, restrict processing, transfer data and object, in accordance with applicable law.

§ 16. Newsletter and marketing communication

The customer may consent to receiving marketing communication by electronic means.

Marketing consent is voluntary and may be withdrawn at any time.

Lack of marketing consent does not affect the ability to place an order.

Communication concerning order fulfilment, payment, delivery, complaint or response to a customer enquiry does not constitute a newsletter and may be conducted for customer service purposes.

§ 17. Customer reviews and content

If the store enables reviews to be added, the customer should post content that is lawful, truthful and does not infringe the rights of third parties.

The Seller may remove content that is unlawful, offensive, infringes personal rights, contains spam or is unrelated to the product or service.

If the store publishes product reviews, the rules for their verification may be indicated next to the review system or in a separate notice.

§ 18. Out-of-court dispute resolution methods

The consumer may use out-of-court methods for handling complaints and pursuing claims.

Information regarding out-of-court methods of resolving consumer disputes is available, among others, on the websites of the Office of Competition and Consumer Protection.

The customer may also seek assistance from a municipal or district consumer ombudsman.

The Seller informs that it does not give prior consent to participate in proceedings concerning out-of-court resolution of consumer disputes, unless such an obligation results from mandatory provisions of law or the Seller individually decides otherwise.

§ 19. Final provisions

The Terms and Conditions apply from the date of their publication on the store's website.

The Seller may amend the Terms and Conditions for important reasons, in particular in the event of:

a) changes in legal provisions,

b) changes in payment or delivery methods,

c) changes in store functionality,

d) changes in the scope of services,

e) the need to clarify customer service rules.

For orders placed before the amendment of the Terms and Conditions, the Terms and Conditions in force at the time of placing the order shall apply, unless the amendment is more favourable to the customer.

In matters not regulated by the Terms and Conditions, applicable provisions of Polish law shall apply.

No provision of the Terms and Conditions is intended to exclude or limit consumer rights arising from mandatory provisions of law.
